By accessing or using the elmgal.com website, or ordering any service through it, you explicitly and unconditionally agree to be bound by these Terms and Conditions. If we execute a formal written agreement or customized proposal for a specific project, any special terms and technical specifications therein shall supersede and take precedence over these general terms.
We provide bespoke website design and engineering, secure cloud hosting, domain registration and renewal, official corporate email management, technical support, software solutions, and workflow automation. The approved written technical and commercial proposal explicitly defines the scope, deliverables, and timeline of each project.
When ordering a custom website development package, the bundle includes the first year of cloud hosting, an official domain registration, and official corporate email accounts free of charge. After the first year, services renew annually at the prevailing rates declared at the time of renewal. This promotional offer does not apply to standalone cloud hosting or domain orders.
Clients are obligated to provide accurate and truthful information, deliver website assets, logos, and written copy within agreed milestones, and warrant that they possess full legal ownership or authorization for all supplied materials. Healthcare facilities, clinics, and medical complexes must verify that all medical content, physician credentials, and licensing strictly comply with applicable healthcare advertising regulations of the competent authorities, as medical content remains the client's sole responsibility.
All prices displayed on the website are exclusive of Value Added Tax (VAT), which is calculated and added to the official invoice in accordance with applicable tax regulations. Payments must be remitted per the payment schedule stipulated in the contract or invoice. Service execution, infrastructure provisioning, and deployment commence only after receipt of the agreed upfront installment.
Cloud hosting and domain names are provisioned for the contracted duration (either paid or free within promotional bundles) and subsequently renew at the prevailing rates published at the time of renewal. We provide timely renewal reminders via email and WhatsApp. Failure to settle renewals on time may result in service suspension, and domain names may be released to the public registry according to applicable ICANN and national registry policies.
Upon complete payment of all project fees without outstanding liabilities, ownership of custom website design assets and proprietary codebase transfers to the client as stipulated in the contract, excluding third-party licensed software, CMS frameworks, or open-source libraries, which remain subject to their respective licenses.
Hosting and official email services may not be utilized for unsolicited commercial emails (SPAM), hosting content in violation of Saudi laws and regulations, or engaging in activities that compromise server security or impair other users. We reserve the right to immediately suspend services upon detection of violations, with prior notice where practicable.
We exercise professional diligence and apply enterprise-grade development standards in delivering our services. However, we do not guarantee specific commercial outcomes beyond technical execution, such as specific revenue, traffic volumes, or fixed search engine rankings.
All cancellations and refund requests are governed by our official Cancellation and Refund Policy published on our website, accounting for operational costs and non-refundable third-party disbursements already incurred (such as domain registration and licensing fees).
